Summary: Use Tome responsibly. Don't abuse the service. We provide the app "as is" and may modify or discontinue features. Respect other users and intellectual property rights.

1. Acceptance of Terms

By downloading, installing, or using the Tome mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Fastmakers Inc. ("Company," "we," "our," or "us"), a Canadian corporation.

2. Description of Service

Tome is a manga collection tracking application that allows users to:

  • Catalog and track manga collections
  • Scan ISBN barcodes to add volumes
  • Create wishlists and custom lists
  • Track lending of books to others
  • Receive notifications about new releases
  • Access a database of manga information

3. Account Registration

To use certain features of the App, you must create an account. When creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You must be at least 13 years old to create an account and use the App.

4. Subscription and Payments

4.1 Free and Premium Tiers

Tome offers both free and premium subscription tiers. The free tier includes core functionality. Premium features require a paid subscription.

4.2 Subscription Terms

Premium subscriptions are billed on a recurring basis (monthly or annually) through the App Store or Google Play. By subscribing, you authorize us to charge your payment method on a recurring basis.

4.3 Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods.

4.4 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to subsequent billing periods.

5. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App or servers
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems or bots to access the App
  • Collect user information without consent
  • Upload malicious code or content
  • Impersonate any person or entity
  • Violate any applicable laws or regulations

6. Intellectual Property

6.1 Our Property

The App, including its design, features, and content created by us, is owned by Fastmakers Inc. and protected by copyright, trademark, and other intellectual property laws.

6.2 Third-Party Content

Manga information, cover images, and related content displayed in the App may be owned by their respective publishers and creators. This content is used for informational purposes to help users track their collections.

6.3 Your Content

You retain ownership of any content you create within the App (such as custom lists or notes). By using the App, you grant us a license to store and display this content as necessary to provide the service.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App or servers are free of viruses or harmful components
  • The manga database information is complete or accurate

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASTMAKERS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE APP.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 CAD, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Fastmakers Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

11. Modifications to Service

We reserve the right to:

  • Modify or discontinue features of the App at any time
  • Update these Terms with reasonable notice
  • Suspend or terminate accounts that violate these Terms

Continued use of the App after changes to these Terms constitutes acceptance of the modified Terms.

12. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App if you violate these Terms or for any other reason at our discretion.

Upon termination, your right to use the App will immediately cease. Provisions that by their nature should survive termination will survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the Province of Ontario, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with Canadian arbitration rules.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fastmakers Inc. regarding your use of the App.
